How overtime is normally calculated

In the United States, the Fair Labor Standards Act requires non-exempt employees to be paid at least one and a half times their regular rate for hours beyond 40 in a week. Some states and many union agreements go further, adding daily thresholds or double time beyond a certain point.

The regular rate is not always just the base wage. Non-discretionary bonuses and shift differentials can be required to be included when calculating it, which raises the overtime rate.

Exempt versus non-exempt

Overtime protection depends on classification, not on job title. Salaried does not automatically mean exempt — exemption requires meeting specific duties and salary-threshold tests. Misclassification is common enough that it is worth understanding which category you genuinely fall into.

The annualised figure is a sanity check, not a forecast

It shows what this week would produce sustained across a year. Treat it as a way to see the scale of the premium, not as an income projection, since overtime is rarely constant and is usually the first thing cut.

Is overtime taxed at a higher rate?
